Terms of Service

1. Acceptance of Terms

By accessing or using MobVex ("the Service"), operated by CEYMOB LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By creating an account, you represent that you meet this age requirement and that the information you provide is accurate and complete.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your login information.

4. Service Description

MobVex provides mobile app analysis tools including but not limited to: ASO evaluation, keyword tracking, piracy detection, competitor analysis, review intelligence, screenshot generation, and version monitoring. Tools and features are subject to change at our discretion.

5. Plans, Credits, and Payments

5.1 Subscription Plans

We offer Free, Pro, and Premium subscription tiers. Each plan provides a specific number of monthly credits. Plan details and pricing are available on our Pricing page.

5.2 Credits

Credits are consumed when you use tools on the platform. Credit costs per tool are displayed on each tool page. Unused monthly credits do not roll over. Additional credit packages can be purchased separately.

5.3 Billing

Payments are processed through Stripe. Subscription fees are charged in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred. You are responsible for providing accurate billing information.

5.4 Plan Changes

Upgrades take effect immediately. Downgrades are scheduled to take effect at the end of the current billing period. No refunds are provided for partial months of service unless required by law.

6. Acceptable Use

You agree not to misuse the Service. Prohibited activities include:

• Automated scraping or excessive API calls beyond reasonable usage
• Attempting to bypass credit or access controls
• Using the Service for any illegal purpose
• Interfering with or disrupting the Service or its infrastructure
• Reselling or redistributing Service outputs without authorization
• Uploading malicious code or attempting to gain unauthorized access

7. Intellectual Property

The Service, including its code, design, logos, and documentation, is owned by CEYMOB LLC and protected by intellectual property laws. You may not copy, modify, or create derivative works without our prior written consent.

Analysis reports and outputs generated through the Service are for your internal business use. You retain ownership of data you input into the Service.

8. Third-Party Services

The Service integrates with third-party services including Google Play Store, Apple App Store, Firebase, Stripe, and AI providers. We are not responsible for the availability, accuracy, or practices of these third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. APP STORE DATA ACCURACY DEPENDS ON THIRD-PARTY AVAILABILITY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CEYMOB LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless CEYMOB LLC and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service ceases immediately.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Any dispute arising from these Terms shall first be resolved through good faith negotiation. If unresolved within 30 days, the dispute shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Sheridan, Wyoming.

15. Force Majeure

Neither party shall be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, power outages, internet or telecommunications failures, or government actions.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
